Privacy Policy
Last Updated: September 9, 2026
SpecialED AI ("we," "our," or "us") provides artificial intelligence-powered tools designed to assist educators, specialists, parents, and school administrators in planning, drafting, and managing special education documentation and strategies. We are deeply committed to protecting the privacy and security of our users and the sensitive educational data entrusted to us.
This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you access or use our web application, tools, and services (collectively, the "Services").
1. Information We Collect
- Account Information: When you register, we collect identifiers such as your name, email address, school or organization name, role/title, and account login credentials.
- User-Provided Content: Text, notes, draft goals, accommodations, and documentation you input into our AI generation workflows ("User Input").
- Payment & Transaction Details: If you subscribe to a paid tier, billing details are processed directly by our third-party payment processors; we do not store full payment card numbers.
- Usage and Device Data: Browser type, operating system, IP address, device identifiers, referring URLs, pages visited, and interaction timestamps.
2. Student Data and Educational Privacy Compliance
Because our Services are used in educational settings, we maintain strict privacy standards regarding student information:
- FERPA (Family Educational Rights and Privacy Act): To the extent that User Input contains "education records" as defined under FERPA, SpecialED AI operates as a "school official" with a legitimate educational interest. We handle such data strictly under the direct control and direction of the educational agency or institution.
- COPPA & Minors: SpecialED AI is designed for use by adult educators, specialists, and parents. We do not knowingly collect personal information directly from children under 13 without appropriate school or parental consent.
- De-Identification Recommendation: We strongly encourage educators and users to input de-identified data (using student initials, generic pseudonyms, or removing identifiable dates of birth and addresses) when drafting Individualized Education Programs (IEPs), 504 plans, or related educational documents.
3. How We Use Information
We process your data to:
- Provide, maintain, and enhance the features of SpecialED AI.
- Process and generate educational drafts, strategies, and instructional accommodations.
- Manage accounts, customer support, and billing.
- Monitor system integrity, prevent fraudulent behavior, and enforce our terms.
- Send administrative notices, service updates, and security alerts.
4. AI Processing and Data Retention
- Model Training: We do not sell student data or identifiable User Input. We do not use private student records or confidential educational documentation submitted through customer accounts to train public-facing foundational AI models without explicit institutional authorization.
- Third-Party AI Processors: We may transmit prompts to enterprise AI infrastructure providers via secure APIs subject to strict confidentiality agreements and commercial data-protection terms prohibiting persistent storage or training on your content.
- Data Retention: We retain account information and generated outputs as long as your account is active, or as needed to fulfill legal and contractual obligations. You may delete your saved documents or request account deletion at any time.
5. Sharing of Information
We do not sell, rent, or trade your personal information. We may share information only under the following conditions:
- Service Providers: Trusted vendors who host infrastructure, handle payment processing, or assist in system analytics under strict confidentiality agreements.
- School or District Administrators: If your account is provisioned under an institutional license, administrators from your district or school may access usage logs and account activity.
- Legal Compliance: When required by subpoena, law enforcement request, court order, or applicable regulation.
6. Security Safeguards
We implement administrative, technical, and physical safeguards designed to protect personal data and educational records against unauthorized access, loss, alteration, or disclosure. These measures include TLS/HTTPS encryption in transit, encryption at rest, and role-based access restrictions.
7. Your Rights and Choices
Depending on your jurisdiction, you may have the right to:
- Access, review, or export your personal information.
- Correct inaccuracies in your account details.
- Request deletion of your personal data and stored content.
- Opt out of non-essential email notifications.
